The website and app, along with all content, services and/or products available on or through the website and app include access to a health management & wellness platform (collectively, the "services") are owned, operated, and brought to you by Arkansas Children's Research Institute (ACRI). This privacy policy describes our policies and procedures regarding the collection, use and disclosure of your personal information on or through these services. PEAKmAAP values the privacy of all visitors and users of services (individually, "users" and collectively, "users"), and we make it a priority to protect all personally identifiable information obtained through these platforms.
In this Privacy Policy, you can find information describing the information PEAKmAAP gathers from you, how PEAKmAAP intends to use the information, and what PEAKmAAP will do to protect that information. By using our services or any part in conjunction with (whether registered for account services or not), users explicitly consent to information handling practices described in this Policy. If you wish to not have information about you used for our study purposes, set forth in this Privacy Policy, please do not access, browse, or otherwise use our services.
This Privacy Policy is incorporated into and is subject to PEAKmAAP's Terms of Service. Your use of PEAKmAAP services or consumption of any sort, along with personal information you provide on or through these services are subject to both the terms of this Privacy Policy and PEAKmAAP's Terms of Service.
PEAKmAAP uses mobile health (mHealth) technology to integrate personalized management into patient's daily routines. The overarching goal of the PEAKmAAP, mHealth project, is to examine the effectiveness of a personalized, integrative website and smartphone application to help improve asthma self-management among adolescents. Further, the project will examine the utility of sharing asthma-related data from the website and app with the patients' primary care provider (PCP). We will not provide information collected in our services to PCPs or other entities without the consent of the parent/caregiver/legal authorized representative (LAR) and/or the user (18 to 20 years of age). This Privacy Policy does not reflect the privacy practices of third party entities or platforms used within or by the PEAKmAAP website and application, and we are not responsible for their privacy policies or practices. We will not review, comment upon, or monitor their privacy policies or their compliance with their respective privacy policies. We also will not review their instructions with respect to our processing of information to monitor compliance with their applicable privacy policies.
It is the policy of Arkansas Children's Research Institute (ACRI), to protect the privacy and confidentiality of medical records and personal information contained in the medical records of persons who are subjects of ACRI Research projects as required by law, including any and all Protected Health Information (PHI) as defined by the HIPAA Privacy regulations.
User-acquired information: When giving your consent/assent to participate in the research project and registering for an account to use PEAKmAAP services or at any time thereafter, PEAKmAAP will be acquiring what is generally considered "personally identifiable information" (such as your name, password, age, gender, email address, postal mailing address, zip code, home/mobile telephone number, primary care physician's name, address and phone number). After obtaining your consent, certain features of the services will ask you to provide other health-related information to further customize the website and application if deemed necessary or helpful in provision of services or any part thereof. If you choose to provide this information, during registration or thereafter, you are giving PEAKmAAP the permissions to use and store it consistent with this policy.
Information from other sources: PEAKmAAP may also obtain information, including personally identifiable information, from other third parties and sources other than in the website and application services. In the event that PEAKmAAP combines or associates information from other sources with personally identifiable information that it collects through services, will treat all combined information as personally identifiable information in accordance with this Privacy Policy.
Third Party Sites/ Services: PEAKmAAP implements third party content or techniques, which allow third party content provider to read and write cookies on the web or application browser, or implement similar tracking mechanisms, in connection with your viewing of the third party content or otherwise made available to through PEAKmAAP services. Third party content, through Google Maps API, AccuWeather API, and Twilio API sites are done so through subscriptions to license agreements and is obtained to display content and resources for PEAKmAAP usage. This information is collected directly by such third parties, and PEAKmAAP does not participate in that data transmission. Information collected by third party entities in this manner is subject to that third party's own data collection, use, and disclosure policies and PEAKmAAP is not responsible for reviews or controls of those policies.
Your communications: Communications with study personnel should be provided to you through enrollment and account setup with PEAKmAAP key research personnel. The research team will maintain communications (via the application, email, SMS, USPS) throughout the research study enrollment period.
PEAKmAAP uses information that you provide and/or that it collects in order to establish and enhance its relationship with you and your asthma related symptoms. PEAKmAAP generally uses this information to operate, maintain, enhance, and provide all of the services and features available to you through website and application usage. This information may be used to provide you with reminders, alerts, educational components, new data or content to be transmitted to your primary care physician and to research study personnel in the procurement for research study purposes, as established in participation consent documents.
PEAKmAAP uses information that you provide or that it collects to keep track of daily logging trends, and to maintain features and functionalities of the mHealth website and application.
PEAKmAAP research personnel and principal research investigators may have legitimate research reasons to obtain access to your personally identifiable information, including but not exclusive to monitoring health related symptoms, contacting primary care physicians, notifying parent/caregiver/legal authorized representative (LAR) about health related symptoms and suggestions for care, and reminders about consistent logging and incentives. PEAKmAAP reserves the right to share user information with people within the ACRI system in relation to the research process, such as study personnel, safety monitoring committees, the Institutional Review Board, or ACRI compliance office. Personally identifiable information will not be used for any services outside the realm of research practices.
Data minimization: PEAKmAAP will only access data and personal identifiable information as relating to the usability and functionality of the core functions of the website and application. PEAKmAAP will not access other protected resources on your devices, such as photos or contact information. Other than location services, no other outside data or information will be accessed without permissions from the user.
Access: PEAKmAAP may use "cookies/cache" to maintain information you have previously entered through the app services, as a way to remember some of your information, so it does not have to be re-entered each time you enter the website or application. Maintaining this information is essential to logging data for health related symptoms and metrics, and well as other personally identifiable information to customize your experience with services. PEAKmAAP will respect the user's permission settings and not attempt to manipulate, trick, or force users to consent to unnecessary data access. The user will be asking during initial account access whether they want to grant permissions to location services. The user has the right to grant or decline permissions, such as location services, at any point in time, by going in manually and making these changes themselves. In the event that this occurs, users must note that these changes may affect the full usage and benefits of third party sites and plug-ins, such as Google Maps API or AccuWeather API.
Personal identifiable information will not be transmitted to third parties. Unless otherwise permitted by law or usage consent, PEAKmAAP will not use, transmit, or share user's personal data or information to third parties for any reason. Likewise, data collected for one purpose will not be used or repurposed without further consent. User's privacy will be respected in accordance with standard Health Insurance Portability and Accountability Act of 1966 ("HIPAA"). Proof of ethics review board approval is available on upon request.
Under the terms of this website and application usage, the user, parent/caregiver/legal authorized representative (LAR) must consent to participation in study requirement. The user must provide all information necessary to properly use the services at full capabilities. This includes providing information to setup a personal profile within the services. Without information PEAKmAAP may not be able to provide to you some of the features and functionalities found on or through services. If you register for an account for services, updates or corrections to your account information can be made by contacting research personnel to edit personal profile information and preferences at any time. To protect your privacy and security, we take reasonable steps to verify your identity, prior to enrollment in the study, and granting access to your account for services. However, you are solely responsible for maintaining the secrecy of your account logins and passwords once given to you at the distribution of the website and application services. If at any time you choose to terminate permissions, participation and services with PEAKmAAP, you have the right to do so. In the event that you wish to withdrawal permissions, participation and services with PEAKmAAP, written notice needs to be sent to the address: Arkansas Children's Hospital, 13 Children's Way, Slot 512-13, Little Rock, AR 72202. The letter need to be signed, including the "Study Title" and state that you wish to revoke your "HIPAA Research Authorization". Thereafter, PEAKmAAP will not share any health related information from the revocation date forward. Any information obtained prior to that date may still be shared to maintain research study reliability. Other extenuating circumstances on temporary removal of permissions can be found in Terms of Services and study consent documents.
As stated in the Choices section, PEAKmAAP uses safeguards to help preserve the integrity and security of the user's personal information. These security measures for personal information and data comply with HIPAA requirement practices. In the event that PEAKmAAP receives notice of a breach of safeguards, PEAKmAAP research personnel will take steps in contacting the user and/or the parent/caregiver/legal authorized representative (LAR) so that you can take appropriate protective measures. At the conclusion of the PEAKmAAP mHealth study, personal information and data acquired will be destroyed, as stated in the consent process and Terms of Service.
This Privacy Policy may be revised periodically without further notice to you and changes will be identified by a "Last modified" date at the top of the Privacy Policy.
